This website is operated by FRAG SUPPLY. Throughout the website, the terms “we”, “us” and “our” refer to FRAG SUPPLY.

These Terms of Service (“Terms”) govern your access to and use of the FRAG SUPPLY website, including any purchases made through our online store.

By accessing our website, creating an account or purchasing a product from us, you agree to these Terms together with any other policies referenced on our website, including our Return & Refund Policy, Shipping Policy and Privacy Policy.

Please read these Terms carefully before using our website. If you do not agree with these Terms, you should not use our website or purchase products from us.

Our online store is hosted using Shopify, which provides the e-commerce platform through which our products are offered and sold.

SECTION 1 – ONLINE STORE TERMS

You must be at least 18 years of age, or have the consent of a parent or legal guardian, to make a purchase through our website.

You must not use our website or products for any unlawful or unauthorised purpose, or use the website in a way that violates any applicable law or regulation.

You must not introduce viruses, malicious code or other material designed to interfere with or compromise the operation or security of the website.

SECTION 2 – OUR PRODUCTS

FRAG SUPPLY specialises in fragrance samples and decants.

Our decants contain genuine fragrance transferred from original fragrance bottles into separate atomisers by FRAG SUPPLY.

Unless expressly stated otherwise, products sold as samples or decants are independently decanted and rebottled by FRAG SUPPLY and are not official manufacturer-produced samples, retail bottles or manufacturer packaging.

FRAG SUPPLY is an independent business and, unless expressly stated otherwise, is not affiliated with, endorsed by, sponsored by or authorised by the fragrance brands referenced on our website.

Fragrance names, brand names, trademarks and other intellectual property belonging to third parties remain the property of their respective owners and are used on our website solely to identify and describe the genuine fragrance from which our decants originate.

SECTION 3 – PRODUCT INFORMATION

We make reasonable efforts to ensure product descriptions, fragrance information, images, prices and other information displayed on our website are accurate and current.

Fragrance notes, descriptions and other fragrance-related information are provided for general informational purposes. Individual perception of a fragrance, including its scent, longevity, projection and development on skin, can vary between individuals.

Images are intended to represent products as accurately as reasonably possible. Colours and other visual characteristics may appear differently depending on your device or display settings.

We reserve the right to update product information, pricing or availability where reasonably necessary. Any such changes will not affect rights you already have in relation to an accepted order.

SECTION 4 – PRICES AND AVAILABILITY

Prices and product availability may change from time to time.

Products may be available in limited quantities and we may discontinue or temporarily remove a product without notice.

Placing a product in your cart does not reserve that product. Availability is confirmed as part of the ordering process.

All prices and charges applicable to your order will be displayed before you complete checkout.

SECTION 5 – ORDERS AND PAYMENT

You agree to provide accurate, complete and current information when placing an order, including your name, email address, billing information and shipping address.

We may decline, place on hold or cancel an order where reasonably necessary, including where:

• a product is unavailable;
• payment cannot be processed or verified;
• information provided with the order appears inaccurate or incomplete;
• we reasonably suspect fraud, unauthorised payment or other unlawful activity;
• an obvious pricing or product listing error has occurred;
• an order appears to have been placed for unauthorised commercial resale; or
• we are unable to fulfil the order lawfully.

Where we cancel an order after payment has been received, we will provide any refund required by law.

We may request reasonable additional information to verify a payment or order where fraud or payment security concerns arise.

Payment processing may be provided by Shopify or other third-party payment providers. Your use of those payment services may also be subject to the relevant provider’s terms and policies.

SECTION 6 – SHIPPING AND DELIVERY

Shipping options, rates and any applicable free-shipping thresholds are displayed on our website and at checkout.

Customers are responsible for providing a complete and accurate delivery address. If you notice an error after placing an order, please contact us as soon as possible.

Delivery estimates are estimates only and may be affected by circumstances outside our reasonable control. We will, however, comply with any obligations that apply to us under Australian Consumer Law.

SECTION 7 – RETURNS, REFUNDS AND CANCELLATIONS

Returns, refunds, replacements and order cancellations are handled in accordance with our Return & Refund Policy and your rights under the Australian Consumer Law.

Because fragrance is highly personal and our products include independently decanted fragrances, we do not provide returns or refunds solely because you change your mind or do not like a fragrance where the product is otherwise as described and free from defect.

Nothing in these Terms or our Return & Refund Policy excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

SECTION 8 – AUTHENTICITY AND BRAND INDEPENDENCE

FRAG SUPPLY takes the authenticity of the fragrances we sell seriously.

Our fragrance decants are sourced from genuine fragrance products and independently transferred into FRAG SUPPLY atomisers.

Unless expressly stated otherwise, the original fragrance manufacturer has not produced, bottled, packaged or endorsed the FRAG SUPPLY decant.

References to fragrance houses, product names and trademarks are made for identification and descriptive purposes. All third-party trademarks, logos and intellectual property remain the property of their respective owners.

Nothing on our website should be interpreted as suggesting an affiliation, partnership, sponsorship or endorsement by any fragrance brand unless we expressly state otherwise.

SECTION 9 – ACCURACY OF WEBSITE INFORMATION

From time to time, our website may contain typographical errors, incorrect prices, inaccurate descriptions, availability errors or other omissions.

Where an error is identified, we may correct or update the relevant information.

If an error materially affects an order you have already placed, we will contact you where reasonably practicable and provide the options available to you, subject to applicable law.

• is unlawful, defamatory, threatening, abusive or discriminatory;

Where you voluntarily submit content for publication, you grant FRAG SUPPLY a non-exclusive, royalty-free licence to reproduce, display and use that content for purposes reasonably connected with operating and promoting FRAG SUPPLY.

We may remove user-submitted content where we reasonably consider it unlawful, inappropriate, misleading or in breach of these Terms.

Unless otherwise stated, the FRAG SUPPLY name, branding, website design, written content, original photography, graphics and other original material appearing on our website belong to FRAG SUPPLY or are used by us with permission.

Third-party fragrance names, trademarks, logos and other intellectual property remain the property of their respective owners.

• third-party websites or services outside our reasonable control; or
• circumstances outside our reasonable control where FRAG SUPPLY has otherwise complied with its legal obligations.

Nothing in these Terms limits any entitlement you may have to compensation for reasonably foreseeable loss or damage arising from a failure to comply with an applicable consumer guarantee.

SECTION 17 – YOUR RESPONSIBILITY FOR MISUSE

You are responsible for loss reasonably suffered by FRAG SUPPLY as a direct result of your unlawful use of our website, fraudulent conduct, infringement of another person’s rights or material breach of these Terms, to the extent permitted by law and except to the extent that the loss was caused or contributed to by FRAG SUPPLY.

SECTION 18 – SUSPENSION AND TERMINATION

You may stop using our website at any time.

We may suspend or restrict your access to our website where we reasonably believe you have materially breached these Terms, engaged in fraudulent or unlawful conduct, or interfered with the security or operation of the website.

Suspension or termination of website access does not remove any rights or obligations relating to orders already placed, refunds, consumer guarantees or other rights that survive under applicable law.

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.
